If you are buying a property with the aid of a mortgage, chances are you may require searches to be carried out. Your solicitors will request this usually near the beginning of a transaction. Ordering searches can be seen as a key stage in the transaction as it can take up to 4 weeks, on average, for all the results to come back. From a seller's viewpoint, you may wish to obtain an update on your buyers search results as this can help you to understand a possible timeframe for the transaction.
As Solicitors, we will require signed terms of business, along with other details, in order to proceed with your transaction. The quicker initial paperwork is returned, the sooner the conveyancing process can begin.
Another key stage in many conveyancing transactions, is the mortgage process. In some cases, this is carried out before the conveyancing process, however in most cases, it is carried out alongside the conveyancing. Given that this is a separate process, it can be subject to delays and it is best to stay on top of the progress so that you are aware of how it can affect the timeframe of your conveyancing. From a seller's viewpoint, it may be best to check with your solicitor if the buyer is obtaining a mortgage and to request timely updates on the progress so that you are aware of the possible affects it can have on your preferred completion date.
This is another key stage in the conveyancing process, which can affect the overall timeframe of the transaction. From the seller's viewpoint, the quicker the documents are returned, the sooner the draft contract paperwork can be issued to the buyer solicitors. From the buyers point of view, the sooner the draft contract pack is received by your solicitors, the sooner your solicitors can review and raise any enquiries accordingly.
This part of the process usually affects the timeframe of your conveyancing the most. After reviewing the draft contract pack, the buyer's solicitors will look to raise enquiries to which they require answers prior to the exchange. This process can be seen as a Question-and-answer session between both sets of solicitors until the buyer's solicitors are satisfied that all their questions have been answered. This can take anywhere from 2-8 weeks depending on the enquiries raised, and whether third-party solicitors are involved (i.e. as found commonly in Islamic Finance transactions).
