Lease Extension

Leasehold is among the myriad of decisions buyers and owners have to deal with. Increasing numbers of properties are built and sold on a leasehold basis and with leasehold property, you are buying the rights to live in a property for a set time.

You may contemplate the advantages of extending the lease term sooner rather than later, and our team of specialists are here to help you get through all the dilemmas from start to finish!

How to qualify?

You need to be a qualifying tenant under The Leasehold Reform, Housing and Urban Development Act 1993, which gives lessees the right to surrender the existing lease and acquire a new lease on their property. To be a qualifying tenant, you must have been the registered owner of a property with a long lease for at least two years.

What is the lease extension process?

  • Eligibility check
  • Initial checks
  • Serving of Notice
  • Compliance with Landlord requirements
  • Consent of Lender (if required)
  • Dealing with the draft Deed of Variation
  • Completion of the Deed
  • Registration of the Deed
However, a voluntary route does not require a notice to be served and can be discussed with the landlord (even prior to becoming a qualifying tenant).
