Lease from the freeholder

All homes are owned on either a freehold meaning you own the property or leasehold basis, meaning you have a lease from the freeholder to use the property for an agreed number of years. DV Solicitors will help you with all the normal legal work involved in buying a property and thoroughly look at the lease and its terms. As your solicitor, we need to check on the length of the remaining lease and make a number of enquiries about your lease to the landlord, such as:
  • The charges you will be liable for as the leaseholder include the service charge and ground rent. Service charges are usually based on an estimate of what the landlord thinks will be spent over the year, whilst ground rent is regular payments agreed on the lease made by a holder of a leasehold property to the freeholder or a superior leaseholder. We will also check when the payment is due and how much it will be.
  • Planned major works such as any renovations or repairs planned for the property that could affect the value of your home, or your enjoyment of it, or the service charge.
  • We will check if your lease has a sinking fund, its balance, and if it can cover any planned work. A sinking fund is a fund to deal with any building work on the property.
  • We will check exactly what the boundaries and limitations of your leasehold property are such as the area it covers (for example if you are buying a top floor flat would it also include rights over the loft space), and if you are allowed to make any renovations to the property without permission.
